Agreement
By accessing and using the Digital Cartel website (digitalcartel.au), you agree to be bound by these terms and conditions. If you do not agree, please do not use this website.
Services
Digital Cartel provides digital marketing services including website design and development, search engine optimisation (SEO), Meta advertising management, social media content, and website hosting and maintenance. All services are subject to a separate service agreement signed before work commences.
Service agreements
Before any work begins, you will receive a written service agreement outlining the scope of work, deliverables, timelines, payment terms, and any applicable guarantees. No work is commenced until this agreement is signed by both parties. The service agreement takes precedence over these general terms where there is any conflict.
Website builds
Website projects are charged as a one-off fee. You will receive a draft for review and approval before the site goes live. Up to two rounds of revisions are included in the quoted price. Additional revisions are charged at $150 per hour (inc. GST). Upon full payment, you own the content and design of your website. We retain the right to showcase the work in our portfolio unless you request otherwise in writing.
Website hosting
Hosting is offered at $100 per month or $999 per year (inc. GST). Hosting includes SSL certification, DDoS protection, 99.9% uptime target, and up to two minor text or image updates per month. Hosting is billed monthly or annually in advance. If hosting payments are not received within 14 days of the due date, we reserve the right to suspend the website until payment is made. If you wish to cancel hosting, we will provide your website files and assist with domain transfer at no additional charge.
Ongoing services (SEO, Ads, Content)
SEO services have a minimum 3-month commitment because rankings take time to build. All other ongoing services are month-to-month with no lock-in. Either party may cancel with 30 days written notice. Monthly fees are billed in advance on the same date each month. Ad spend is paid directly by the client to the advertising platform (Meta, Google) and is separate from our management fee.
The guarantee
We guarantee measurable improvement in your online enquiries. Before commencing, we agree on specific, measurable targets (lead volume, enquiry numbers, ranking positions). If we do not meet these targets within the agreed timeframe, you do not pay for that period. This guarantee applies to ongoing services only (SEO, Ads, Full Service), not to one-off website builds. The guarantee requires that the client provides reasonable cooperation, access to required accounts, and timely feedback.
Referral program
Refer a business that signs a minimum 3-month service agreement and receive one month free on your current package. Refer ten qualifying clients and receive one year free. Referral credits are applied to your next billing cycle and cannot be exchanged for cash. We reserve the right to modify or discontinue the referral program at any time with 30 days notice to active participants.
Intellectual property
All website designs, code, copy, and creative assets produced for you become your property upon full payment. We retain the right to use anonymised case studies and portfolio examples unless otherwise agreed. Our own brand assets, tools, templates, and proprietary systems remain our intellectual property.
Limitation of liability
To the maximum extent permitted by law, Digital Cartel's total liability for any claim arising from our services is limited to the amount you paid us in the 3 months preceding the claim. We are not liable for any indirect, consequential, or incidental damages, including lost profits or lost data. Nothing in these terms excludes or limits any consumer guarantees under the Australian Consumer Law that cannot be excluded.
Dispute resolution
If a dispute arises, both parties agree to attempt resolution through direct negotiation first. If that fails, the dispute will be referred to mediation in Queensland before any legal proceedings are commenced. These terms are governed by the laws of Queensland, Australia.
Changes to these terms
We may update these terms from time to time. Continued use of the website constitutes acceptance of the updated terms. Material changes will be communicated via email to active clients.
